Estate Planning Client Profile #149 | Single Woman | One Minor Child | Dual Citizen

This client was a single woman with one minor child. She wanted to provide for her child.

We created a trust plan for her, which included a:

  • Trust;
  • Will;
  • Power of Attorney for the Care of Minor Child;
  • Designation of Health Care Representative for Minor Child;
  • Financial Power of Attorney;
  • Power of Attorney for Health Care;
  • Advance Health Care Directive;
  • Disposition Instructions;
  • Babysitter Emergency Manual;
  • Letters to Short-Term Guardians; and
  • Deed.

The Trust enables the woman to accomplish her goals in providing for her child.

The Will provides security in case the client misses transferring any assets into her Trust. It appoints a Personal Representative to transfer any assets into the Trust.

The Power of Attorney for the Care of Minor Child appoints a short-term guardian to care for her child if an emergency occurs.

The Designation of Health Care Representative for Minor Child names someone to act as short-term guardian and manage her child’s health care if she is unable to do so.

The Financial Power of Attorney states who the client would like to manage her assets if she is ever unable to do so herself.

The Power of Attorney for Health Care names people to manage the client’s health care if she cannot.

The Advance Health Care Directive includes direction about what the client would like to receive for health care if she is ever incapacitated.

The Disposition Instructions state what the client would like to happen to her remains after she is gone.

The Babysitter Emergency Manual includes instructions to the babysitter about what to do and what not to do if an emergency occurs. It also lists the names and contact information of the parents and short-term guardians.

The Letters to Short-Term Guardians have instructions to the short-term guardians in caring for the child, and lists the names and contact information of the long-term guardians.

The Deed transfers the client’s real property into her Trust, so it can avoid probate and be used or distributed in the manner in which she chooses.
