This client was a married woman with no children. She wanted to create a probate avoidance trust that provided her estate in a trust for the lifetime of her husband.
We created a trust plan for her that included a:
- Trust;
- Pour-Over Will;
- Financial Power of Attorney;
- Healthcare Power of Attorney; and
- Living Will.
The Trust enables the client to accomplish her goals in avoiding probate and protecting her estate.
The Pour Over Will provides security in case the client misses transferring any assets into the Trust. It allows the Personal Representative settling the estate to “pour” any assets outside of the Trust into the Trust.
The Power of Attorney documents are to provide for the client if she is ever in a situation in which she cannot make financial or medical decisions for herself.
We prepared the Living Will for end of life decisions and to take the mystery out of what the woman would want to happen to her if she is ever in a permanent vegetative state.
