This client was a single woman with two adult children. We created a trust plan so that she could provide for her children and her ex-husband. We also created Power of Attorney documents naming her and her ex husband as agents for her children.
The Trust plan for the client included a:
- Trust;
- Pour Over Will;
- Financial Power of Attorney;
- Healthcare Power of Attorney;
- Living Will; and
- Deed.
The Pour Over Will provides for any assets that may be missed being placed in the trust. It allows the Personal Representative, or Trustee, settling the estate to “pour” any assets outside of the trust into the trust.
The Power of Attorney documents are to provide for the client in the event that she was in situation where she cannot make financial or medical decisions for herself. We prepared the health care directive for end of life decisions and taking the mystery out of what the client would want to happen to her if she was in a permanent vegetative state.
The Deed we prepared conveyed her home into the trust, so that in the event of her death, the Trustees could sell the house or pass it down to her children.
