These clients were a married couple in their mid-forties, with three minor children. They wanted to provide for their children’s future in case anything happened to them when their children were still minors.
We created a will plan for both the husband and wife, with each containing a:
- Will;
- Power of Attorney;
- Healthcare Power of Attorney; and
- Health Care Directive.
This works well for this couple as they do not have many assets, so a simple probate would be cost efficient and easy for their children to manage. The Will also designates that their entire estate pass to their children.
The Power of Attorney documents provide the couple with designations for individuals to take care of them if they become incapacitated.
We also included guardian designations and short-term guardian instructions to provide the family with a safety net in case an emergency occurs. These designations state who would take care of their children and what they need to do until the designated long-term guardians could arrive and obtain custody.
We prepared the Health Care Directive for end of life decisions, and to take the mystery out of what the couple would want to happen to them if they were in a permanent vegetative state.
